The Supreme Court’s ruling, published Wednesday morning as an informal ruling and not a final decision, suggested the court would reject Idaho’s appeal but leave the core issue unresolved, according to Bloomberg.
Supreme Court spokeswoman Patricia McCabe said in a statement to Forbes that the decision “has not yet been published” and that the document was “incorrectly uploaded to the Supreme Court’s website in a short space of time,” adding that the decision would be released “in due course.”
In Moyle v. United States, the federal government argued that hospitals in the state are required by federal law to provide abortions in emergency situations, even if the state does not permit it.
Idaho’s 2020 defense of life law allows abortions only when “necessary to prevent the death of the pregnant woman” or in situations involving rape or incest.
