Mayer Brown’s Capital Markets and Financial Services Regulation team cordially invites you to a 30-minute know-how webinar. In this series, we will report on the key developments in 2024 related to capital markets, structured products, derivatives and financial regulators.

The third webinar will focus on own funds and eligible debt: lessons learned from the EBA’s monitoring report.

In July 2023, the EBA updated its monitoring reports for AT1, Tier 2, TLAC and MREL products, merging the previous two reports for own funds and eligible debt into one report. The EBA has also added new recommendations regarding specific contractual clauses in corresponding documents. As a result of these changes, the EBA has begun adjusting certain own funds and eligible debt components. Additionally, the EBA continues to publish Q&As on both its own funds and eligible debt schemes and has started issuing letters on specific eligibility issues for outstanding instruments.

Our webinar will discuss the first practical experience with the application of the new monitoring report, summarize the current recommendations and Q&A status with a particular focus on Tier 2 and eligible debt, and discuss current and future monitoring reports. Analyze the impact of Banks requesting new issues as well as unpaid items and consents.
