HORRY COUNTY, S.C. (WBTW) — The South Carolina Attorney General’s Office has declined to prosecute a North Myrtle Beach business owner following a September shooting in the Loris area.

The shooting occurred Sept. 9 at the intersection of Camp Swamp Road and Highway 9, according to the Horry County Coroner’s Office. Scott Spivey, 33, was killed in the shooting.

An Horry County police report obtained by News13 shows Spivey allegedly started shooting, and officials in the report say Spivey jumped out of the car and began firing at them. , states that police fired back and killed him.

15th Circuit attorney Jimmy Richardson wrote a letter to the state attorney general’s office less than a week after the shooting. In his letter, Richardson said Horry County police are trying to determine if a crime was committed. He said he has asked the South Carolina Law Enforcement Division to assist in the investigation.

One of the reasons Horry County police requested SLED’s assistance was because Weldon Boyd, who was involved in the shooting and is also the owner of the North Myrtle Beach business Buise on the Boulevard, posted on Facebook, “Thank you. ” for posting a message. The incident was reported to the police and attorney’s office on September 14th.

Richardson said he received several calls from community leaders asking questions about the incident before and after posting on Facebook. He added that rumors began to spread as the investigation progressed.

A spokesperson for the Attorney General’s Office told News 13 on Friday that they declined to prosecute Boyd due to insufficient evidence.
