Alabama teller accused of defrauding customers; state searching for more victims

Alabama Attorney General Steve Marshall has filed a restraining order against Legend Windows LLC, alleging that the company deceived customers into paying for new windows and doors but never delivered the products.

The temporary restraining order was issued by Shelby County Circuit Court and also targets Jody Ray Whitworth, Bobby Ray Whitworth and Robin Simmons Willard, who are also associated with the business. The order includes an asset freeze and prohibits the business from operating while the court reviews the matter.

“Legend Windows and the Whitworth Brothers have been preying on customers and perpetrating this fraud for far too long, and it is time they were held accountable for their crimes,” Marshall said in a news release. “These defendants have a history of property theft and have repeatedly committed crimes while demonstrating zero remorse for their fraudulent acts.”

According to the state’s complaint, the company violated Alabama’s Unfair Trade Practices Act 42 times, identifying more than 40 victims across the state and awarding damages totaling $181,042.80.

Jody Whitworth is accused of using customer payments to make personal purchases instead of providing the products and services the companies were advertising.

According to a news release, between September 2022 and March 2024, Legend Windows’ bank account made more than 1,100 purchases totaling nearly $50,000 on Amazon, as well as more than $20,000 in purchases from Thame, Etsy, JCPenney, TJ Maxx, Ross, Marshalls, Scentsy, Plato’s Closet, Nordstrom, Kohl’s and Burlington.

The Attorney General’s Office believes there are other victims across the state and has launched an online survey where those who have not yet been identified can bring their allegations to the Attorney General, available here: https://www.alabamaag.gov/consumer-questionnaires/.
